A pesar de haber ganado popularidad a nivel mundial en los últimos años, las APPs no están libres de controversias.
Las asociaciones público-privadas (APPs) fueron desarrolladas e implementadas desde inicios de los 90, donde el Reino Unido fue el pionero en esta materia. Desde su lanzamiento han ido ganando popularidad entre los diferentes países como una herramienta adicional para proveer de servicios o bienes públicos a la sociedad.
Los casos de éxitos como los de fracasos de las últimas décadas permiten a aquellos países que todavía no han aplicado las APPs, como Bolivia, beneficiarse de estas experiencias para construir un marco legal y financiero apropiado.
Es importante mencionar que no se puede aplicar la estructura de una APP a todos los proyectos que proveen un bien o servicio público, cada país decide en que tipo de proyectos podrá participar el privado. Una gran ventaja es que cuando participa el privado aporta capital y financiamiento que libera recursos al Estado, los cuales pueden ser utilizados en otros proyectos que sean netamente de inversión pública. En tal sentido, las APP pueden coadyuvar a la provisión de servicios y bienes públicos sin aumentar el endeudamiento del Estado.
Bolivia ha dado sus primeros pasos en desarrollar un marco legal para reglamentar cierto tipo de asociaciones público-privadas, sin embargo, hasta la fecha no se ejecutado ningún proyecto bajo esa estructura. En el documento se propone lineamientos técnicos, legales y financieros que se deberían considerar al momento de desarrollar las APP’s en el país.
